DEFECTIVE PRODUCTS

When someone is injured while using a product that left the manufacturer or seller’s hands in a defective or dangerous condition, he or she may be able to recover damages from the responsible party.  A “product” is anything that is sold with the exception of real estate and services.

A manufacturer should be held accountable when a consumer is injured by the proper use of a product.  Defective products whose labels fail to warn the consumer of likely hazards and improper use can result in liability for the manufacturer and seller if an injury or death occurs.  Manufacturers are usually in the best position to prevent defective products from entering the marketplace, and if they fail to do so, they should be held accountable.

Early investigation of defective product claims can be vital.  Steps to preserve physical evidence, investigate relevant scenes (fire losses for example), and take witness statements are all essential to success.  Physical evidence needs to be evaluated by a well-qualified expert as soon as possible.  Photographs or videotapes of the product or scene should also be taken as soon as possible.  Witness statements need to be taken promptly in order to preserve critical evidence.

Persons injured by defective products need a personal injury attorney who is skilled in the complex area of products liability law.  We stand ready to assist you and to promptly take the action necessary to gather and preserve important evidence.

If you have suffered personal injuries as a result of using a defective product, an experienced and knowledgeable attorney can advise you on whether you may have a claim against the product manufacturer or seller.  The attorneys at Pryor, Flynn, Priest & Harber will protect your interests and work hard to get you the best possible result.
